This document (hereinafter referred to as'Information“) contains information about the processing of personal data in the company coworkers.ai s.r.o. conversational platform product coworkers.ai in accordance with Article 12 et seq. Regulation (EU) 2016/679 of the European Parliament and of the Council of 27.4.2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as “)GDPR “) and Act No. 110/2019 Coll., on the processing of personal data.

Further information about the processing of personal data in the company coworkers.ai s.r.o is set out in Annex No. 4, which is part of the contract.

We have not appointed a Data Protection Officer, as we are not an obligated person under Art. 37 GDPR.

3. SUPERVISORY AUTHORITY

A supervisory authority is an independent public authority responsible for the protection of personal data in a given state. The supervisory authority at the location of the headquarters of coworkers.ai s.r.o is the Office for Personal Data Protection with its registered office in Pplk. Sochora 27, 170 00 Prague 7, e-mail: posta@uoou.cz, tel.: +420 234 665 125.

4. POSITION coworkers.ai s.r.o

Within the framework of the Coworkers.ai conversational platform product, coworkers.ai s.r.o acts both as a personal data controller and as a personal data processor. In the position of personal data controller coworkers.ai s.r.o acts in relation to the personal data of customers — Article 2 of this information.
In relation to the personal data stored by the customer on the servers of coworkers.ai s.r.o, coworkers.ai s.r.o acts as a processor, as it only provides the customer with data space for the purpose of storing the data. The controller of this personal data is the customer himself — Article 3 of this Information.

Within the coworkers.ai product, coworkers.ai s.r.o acts as a personal data controller in relation to the personal data of customers and website visitors.

1. PERSONAL DATA OF CUSTOMERS, IF THEY ARE NATURAL PERSONS, OR CUSTOMER REPRESENTATIVES

Purpose of processing and categories of personal data
In order to fulfill the contract (in particular, to conclude a contract, to communicate with the customer), or to carry out the measures taken before the conclusion of the contract (negotiations before the conclusion of the contract), we process in particular: name, surname (if it is a natural person doing business), address of place of business, billing address, ID/TIN, name and surname of the contact person, position, e-mail, telephone.

In order to fulfill legal obligations (especially bookkeeping, issuing and registering tax documents), we process in particular: name, surname (if it is a natural person doing business), address of place of business, ID/TIN. Due to legitimate interest, we process: e-mail (sending commercial communications).

In the event that we intend to process personal data other than that referred to in this article, or for other purposes, we may only do so on the basis of a validly granted consent to the processing of personal data. Consent to the processing of personal data is granted by the data subject on a separate document.

Period of processing of personal data
We process personal data processed for the fulfilment of obligations arising from special legal regulations for the period stipulated by these legal regulations. If the use of personal data is necessary for the protection of our legitimate interests, we process such personal data for the period necessary to exercise these rights. If personal data is processed on the basis of consent, we only carry out the processing for the period for which the consent is granted.

2. PERSONAL DATA OF VISITORS TO OUR WEBSITE

Purpose of processing and categories of personal data
Due to legitimate interest, we process: IP address or other online identifiers (the purpose of processing is security, analysis of website traffic). More information about how cookies are handled can be found in the Cookies Policy.

3. SPECIAL CATEGORIES OF PERSONAL DATA

We do not process any personal data that can be classified as a special category (so-called sensitive data) within the meaning of Art. 9 GDPR. At the same time, we do not process personal data relating to judgments in criminal cases and crimes within the meaning of Art. 10 GDPR.

coworkers.ai s.r.o provides customers with data space for the purpose of storing data within the framework of the CHATBOT and VOICEBOT service, namely on the servers of coworkers.ai s.r.o or third parties that are in a contractual relationship with coworkers.ai s.r.o. Personal data of other natural persons (data subjects) may also be part of customer data. In relation to these personal data, coworkers.ai s.r.o acts as the processor of personal data. The controller of this personal data is the customer himself.

‍End-user warnings: If the customer processes personal data of natural persons with the help of CHATBOT and VOICEBOT, the data subjects must contact the customer directly with questions regarding the protection of personal data, since he is in the position of the controller of personal data. We cannot be responsible for the privacy policies or security practices used by Customer, which may differ from this Information.

‍Purpose of data processing and processing: We do not perform any operations with customer data, including personal data, except for storing them on our servers, in particular we do not interfere with them, change them, make them available or transfer them to third parties (except for their disclosure to state authorities in accordance with the law), unless the parties agree otherwise. The sole purpose of processing this personal data is to store it and make it available to the customer.

‍Type of personal data processed: It is impossible to determine exactly, most often it is the name, surname, ID/TIN, address of the place of business, e-mail, telephone.

Recipients of personal data, transfer of personal data to third countries

1. OTHER PERSONAL DATA CONTROLLERS

We do not transfer personal data to any other personal data controllers.

We transfer personal data processed for the fulfillment of obligations arising from special legislation to state authorities or other competent authorities only in cases where we are required to do so by law.

2. PROCESSORS OF PERSONAL DATA

The processing of personal data for us can be carried out exclusively by processors on the basis of a personal data processing contract, i.e. with guarantees of organizational and technical security of such data with a definition of the purpose of processing, while processors may not use personal data for other purposes.

3. TRANSFER OF PERSONAL DATA TO THIRD COUNTRIES

We do not transfer personal data to third countries or international organisations within the meaning of Article 44 et seq. GDPR.

Rights of data subjects

In connection with the protection of personal data, you have the following rights. If you would like to exercise any of these rights, please contact us via contact email. The exercise of these rights is subject to certain exceptions in some cases and may therefore not be possible to apply them in all situations. If your request is found to be justified, we will take the required measures without undue delay, no later than one month. In justified cases, we may extend this period by up to another two months.

As a data subject, you have:

‍Right of access to personal data (Art. 15 GDPR): You have the right to obtain confirmation from coworkers.ai s.r.o whether or not your personal data is being processed. If your personal data is processed by coworkers.ai s.r.o, you have the right to access such personal data and to the information referred to in Art. 15 GDPR. At the same time, you have the right to obtain a copy of the processed personal data. For additional copies, coworkers.ai s.r.o may charge you a reasonable fee, taking into account administrative costs.

‍Right to rectification of personal data (Art. 16 GDPR): You have the right to have coworkers.ai s.r.o correct your inaccurate personal data without undue delay or complete incomplete personal data.

‍Right to erasure of personal data (Art. 17 GDPR): You have the right to have coworkers.ai s.r.o delete your personal data without undue delay in the cases provided for in Art. 17 GDPR. The right to erasure does not apply if the processing is necessary for the fulfilment of legal obligations, for the determination, exercise or defence of legal claims and in other cases provided for in the GDPR.

‍Right to restriction of processing (Art. 18 GDPR): You have the right to have coworkers.ai s.r.o restrict the processing in any of the following cases: a) you deny the accuracy of the personal data for the period necessary for coworkers.ai s.r.o to verify the accuracy of the personal data; b) the processing is unlawful and you refuse to delete the personal data and request instead to restrict its use; c) coworkers.ai s.r.o no longer needs the personal data for the purposes of processing, but you request them for the establishment, exercise or defence of legal claims; (d) you have objected to the processing; until it is verified that the legitimate grounds coworkers.ai s.r.o prevail over your legitimate reasons.

‍Right to information regarding correction or erasure of personal data or restriction of processing (Art. 19 GDPR) coworkers.ai s.r.o is obliged to notify the individual recipients to whom the personal data has been disclosed of any correction or deletion of personal data or restriction of processing, except in cases where this proves impossible or requires unreasonable effort. If you request this, coworkers.ai s.r.o will inform you about these recipients.

‍Right to data portability (Art. 20 GDPR): If technically feasible, you have the right to obtain your personal data and transfer this data to another controller.

‍Right not to be subject to automated individual decision-making, including profiling (Art. 22 GDPR): When processing personal data, coworkers.ai s.r.o does not carry out automated individual decision-making or profiling within the meaning of Art. 22 GDPR.

‍Right to be informed in the event of a personal data breach (Art. 33 GDPR): If it is likely that a personal data breach will result in a high risk to your rights and freedoms, coworkers.ai s.r.o will notify you of the breach without undue delay.

‍Right to lodge a complaint with the supervisory authority: If you believe that coworkers.ai s.r.o does not process your personal data in a lawful manner, you have the right to lodge a complaint with the supervisory authority whose contact details are listed above. We will be very happy if you contact us first. We will do everything in our power to correct the defective situation and process your personal data in a lawful manner.

‍Right to object to processing (Art. 21 (1) GDPR): You have the right to object at any time to the processing of your personal data processed by coworkers.ai s.r.o on the grounds of a legitimate interest. In this case, coworkers.ai s.r.o will no longer process the personal data unless it proves compelling legitimate grounds for processing that outweigh your interests or rights and freedoms, or for the establishment, exercise or defense of legal claims.

‍Right to object to processing for direct marketing purposes (Art. 21 (2) GDPR): If coworkers.ai s.r.o processes your personal data for direct marketing purposes, you have the right to object to such processing at any time. coworkers.ai s.r.o does not process personal data further.

‍Right to withdraw consent to the processing of personal data: If coworkers.ai s.r.o processes any of the personal data on the basis of consent, you have the right to withdraw your consent to the processing of personal data at any time in writing, by sending your consent to the processing of personal data to the contact e-mail address. Withdrawal of consent is without prejudice to the processing of personal data in cases where consent is not required.
